## EM HOME SOLUTIONS LTD: Terms and Conditions of Occupancy By completing a booking and checking the mandatory agreement box, the guest acknowledges and accepts these Terms and Conditions, which constitute the full legal agreement (a **temporary license to occupy**) between the guest and EM Home Solutions Ltd. --- ### 1. Booking Confirmation and Contract Formation **1.1. Contract Formation** A booking is confirmed only upon the guest's receipt of a confirmation email and payment of the booking fee. This agreement grants a **temporary license to occupy** the premises for the confirmed duration and is **expressly not a lease or tenancy agreement**. **1.2. Guest Responsibility** The guest must be a minimum of **18** years of age and is fully responsible for all members of their party. Misrepresentation of the party size will result in immediate termination of the license without refund. **1.3. Verification & Security** To safeguard against fraud and maintain security standards, we reserve the right to verify the identity of the booking party against valid photo identification and the payment method used prior to check-in. --- ### 2. Security Deposit Policy (Two-Tier System) The required security guarantee is between **€350 (Euros)** and **€450 (Euros)**, determined by the size and value of the specific accommodation booked. **2.1. Standard Deposit Guarantee (Stays under 28 Days)** A fully **refundable damage guarantee** is required. The exact amount, **€[booking.damage_deposit] (Euros)**, is processed as a secure **pre-authorization hold only (no funds are debited)** via our **trusted European financial security partner, Swikly**. The hold is initiated **5** days prior to arrival and released automatically upon satisfactory post-check-out inspection. **2.2. Mandatory Long-Term Deposit (Stays of 28 Days or More)** Due to the extended duration, the security deposit amount (i.e., **€350 or €450 Euros**) is required to be **fully debited (charged)** as a payment, not a hold, **7 days prior to arrival**. This amount is held securely by EM Home Solutions Ltd and is **100% refunded** within 7 days following check-out, provided no damage or breach of contract has occurred. **2.3. Currency and Fees Transparency** **All deposit transactions are processed in Euros (€) as standard procedure, mandated by our secure European payment partner, Swikly, to maintain cross-border financial compliance.** The guest is solely responsible for any currency conversion fees applied by their bank during the hold or refund process. --- ### 3. Payment and Cancellation Policy **3.1. Full Refund Period (Long Lead Time)** Guests may cancel their booking up to **30 days** before the scheduled arrival date and receive a full refund of the accommodation charges, **minus any non-refundable payment processing fees and bank charges** incurred by EM Home Solutions Ltd (e.g., fees retained by Stripe, Swikly, or the card issuer). **3.2. Partial Refund Period (Medium Lead Time)** If the booking is cancelled between **14 and 30 days** before the scheduled arrival date, the guest will receive a **50% refund** of the accommodation charges, minus any non-refundable payment processing fees incurred by EM Home Solutions Ltd. **3.3. No Refund Period (Short Lead Time)** If the booking is cancelled less than **14 days** before the scheduled arrival date, **no refund** will be provided. The full cost of the stay will be retained. **3.4. Failed Payments** Failure to provide a valid payment method for the deposit or final balance by the required due date may result in the automatic cancellation of the reservation without refund. --- ### 4. Property Access and Procedures **4.1. Times** Standard check-in is **3:00 PM** and check-out is strictly **10:00 AM**. Unauthorized late check-outs will result in a penalty fee of **£50** per hour. **4.2. Access** Access details (codes, key instructions) will be sent via email on the **morning of the day of check-in** (0 days prior), provided all payment and deposit requirements have been met. **4.3. Property Condition** The guest agrees to leave the property in the same clean and tidy condition as found, excluding normal use. Excessive cleaning required will be charged against the security deposit. **4.4. Right of Entry (NEW)** The guest agrees that EM Home Solutions Ltd, or its authorized personnel (e.g., maintenance, cleaners), shall have the **right of access** to the property at all reasonable times (and in case of emergency, without prior notice) for the purpose of essential maintenance, inspection, or to remedy a breach of these terms. **4.5. Lost Keys/Fobs Fee (NEW)** The guest is responsible for the safekeeping of all keys, fobs, and access cards. Lost, damaged, or non-returned keys, fobs, or access cards will incur a charge of **£75** per item to cover replacement and re-coding costs. --- ### 5. House Rules and Conduct **5.1. No Smoking** Smoking (including vaping) is strictly prohibited inside the property. Violation will result in a minimum penalty fee of **£200** to cover deep cleaning and loss of revenue. **5.2. Parties and Noise** Parties, events, and excessive noise are strictly prohibited. Quiet hours are enforced between **9:00 PM** and **9:00 AM**. Violation will result in immediate termination of the license without refund. **5.3. Pets** **Pets are not permitted under any circumstances.** **5.4. Maximum Occupancy (NEW)** The maximum number of occupants for the property is strictly limited to the number confirmed at the time of booking. Failure to adhere to this limit, or allowing unauthorized persons to stay overnight, will be considered a breach of contract and may result in an immediate termination of the license without refund, and a penalty charge of **£150** per unauthorized person, per night. **5.5. Commercial Use** The property is for residential purposes only. Commercial use, filming, or photography without prior written consent from EM Home Solutions Ltd is strictly prohibited. --- ### 6. Critical Legal Clauses (Guaranteed Security) **6.1. Full Liability for Damages** The guest is financially responsible for all damage, loss, or excessive cleaning costs occurring during their stay. **Liability is not limited to the security deposit amount.** We pursue claims transparently based on evidence. **6.2. Failure of Services (NEW)** EM Home Solutions Ltd is not liable for the failure or interruption of utilities, appliances, communications (e.g., Wi-Fi, television), or other services within the property or the building structure that are outside of our reasonable control. We will take all reasonable steps to rectify any such failures promptly upon notice. **6.3. Termination of License and Trespass** This temporary license to occupy terminates automatically and without notice precisely at the stated check-out time. **If the guest remains on the premises after this time, they shall be deemed a trespasser.** **6.4. Right of Entry and Self-Help** If the guest is deemed a trespasser (see 6.3), **EM Home Solutions Ltd** is contractually authorized to use **self-help remedies** to re-secure the property, including **disabling access codes/changing locks**, removing guest possessions, and contacting law enforcement for immediate removal. The guest waives all claims for damages or liability arising from the legal exercise of this right. **6.5. Indemnification** The guest agrees to indemnify and hold harmless **EM Home Solutions Ltd** from any and all claims, liabilities, and expenses, including reasonable legal fees, arising from the guest's use of the property or any breach of this agreement. **6.6. Governing Law** This agreement shall be governed by and construed in accordance with the laws of **England and Wales**.
